Package travel information

This page sets out the information that must, by law, be provided to every traveller before booking a package holiday with Ourway Travel S.L., together with the details of the guarantee that protects you should the agency become insolvent.

Standard information form

The combination of travel services offered to you is a package travel within the meaning of the Consolidated Text of the General Law for the Protection of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007 of 16 November. Therefore, you will benefit from all the rights that apply under EU law to package travel. The company Ourway Travel SL will be fully responsible for the proper performance of the package travel as a whole. Furthermore, as required by law, the company Ourway Travel SL is covered by a guarantee to reimburse your payments and, if transport is included in the trip, to ensure your repatriation in the event that it becomes insolvent.

Key rights under the Consolidated Text of the General Law for the Protection of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007 of 16 November:

  • Travellers will receive all essential information about the package travel before the package travel contract is concluded.
  • There will always be at least one trader responsible for the proper performance of all the travel services included in the contract.
  • Travellers will be given an emergency telephone number or the contact details of a point of contact where they can get in touch with the organiser and, if applicable, the retailer.
  • Travellers may transfer the package travel to another person, with reasonable notice and, if applicable, subject to the payment of additional costs.
  • The price of the package travel may only be increased if specific costs increase (for example, fuel prices) and this is expressly stipulated in the contract, and in no case during the last twenty days before the start of the package travel. If the price increase exceeds eight per cent of the price of the package travel, the traveller may terminate the contract. If the organiser reserves the right to increase the price, the traveller will have the right to a price reduction if the relevant costs decrease.
  • Travellers may terminate the contract without paying any termination fee and obtain a full refund of all payments made if any of the essential elements of the package travel, other than the price, are significantly changed. If the trader responsible for the package travel cancels it before its start, travellers are entitled to a refund of payments made and, where applicable, to compensation.
  • In exceptional circumstances — for example where there are serious security problems at the destination which are likely to affect the package travel — travellers may terminate the contract before the start of the package travel without paying any termination fee.
  • Additionally, travellers may terminate the contract at any time before the start of the package travel in return for payment of an appropriate and justifiable termination fee.
  • If significant elements of the package travel cannot be provided after the start of the trip, suitable alternative arrangements must be offered to the traveller at no extra cost. Travellers may terminate the contract without paying any termination fee where services are not performed in accordance with the contract, where this substantially affects the performance of the package travel and the organiser fails to remedy the problem.
  • Travellers are also entitled to a price reduction and/or compensation for damages in the event of non-performance or improper performance of the travel services.
  • The organiser and the retailer must provide assistance to the traveller if the traveller is in difficulty.
  • If the organiser or, if applicable, the retailer becomes insolvent, payments will be refunded. If the organiser or, if applicable, the retailer becomes insolvent after the start of the package travel and the package travel includes transport, repatriation of travellers will be secured. Ourway Travel SL has taken out insolvency protection with MARKEL INSURANCE SE. If services are denied because Ourway Travel SL becomes insolvent, travellers may contact MARKEL INSURANCE SE (by email at [email protected], telephone +34 91 788 6150, and at Paseo de la Castellana, 259C, Floor 34, 28046 Madrid).

Insolvency protection
