1. Legal Regulation and Acceptance of Conditions

The contracting of any of the trips offered by Ourway Travel S.L. implies the total acceptance of these general conditions, which are considered automatically incorporated into the contract, without the need for their written transcription. These conditions are governed by the provisions of Real Decreto Legislativo 1/2007, of November 16, approving the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, as well as by any other current regulations applicable to it.

3. Booking and Payment Process

A booking request constitutes an offer for a package travel contract. Such booking will not be considered firm until receipt of a deposit of 30% of the total trip amount or, failing that, a minimum of 100€ per person, which will not be refundable as management expenses. The remaining amount must be paid no later than 30 calendar days before the start of the trip. For bookings made less than 72 hours in advance, 100% of the amount will be required at the time of confirmation. Accepted payment methods are bank transfer, credit/debit card, PayPal and Bizum.

4. Booking Modifications

Customers may request modifications to their booking (dates, itinerary, number of people) by communicating it in writing. Modifications requested more than 15 days before the start of the trip may be subject to a management fee, in addition to any costs passed on by service providers. Modifications requested less than 15 days before will be treated as a cancellation and will be subject to the corresponding penalties. In the event that the agency is forced to make significant modifications before the start of the trip, the customer will be notified immediately and may choose to accept the modification, take a substitute trip of equivalent or superior quality, or terminate the contract with the right to a full refund of amounts paid.

5. Cancellation Policy

Customers have the right to terminate the contract at any time before the start of the trip. However, they must pay a penalty that will depend on how far in advance the cancellation is communicated:

  • A penalty of 100% of the total trip amount if the cancellation occurs less than 20 days before the start of the trip.
  • If the cancellation occurs 20 days or more in advance, customers will be entitled to a refund of the amount paid, deducting only the management expenses (100€ per person) and the justified cancellation expenses of the providers.
  • In case of no-show on the day of the trip start, a 100% penalty of the total trip amount will be applied without right to refund.

The agency reserves the right to cancel the trip due to force majeure or if the minimum number of participants required for group trips is not reached, refunding the customer the full amount paid.

6. Travel and Cancellation Insurance

All our trips include basic travel assistance insurance. Additionally, we strongly recommend purchasing optional cancellation insurance to cover possible cancellation expenses arising from justified causes. The cost of such insurance is not refundable in any case. Voluntary interruption of the trip once started will not give right to any type of refund for services not enjoyed.

7. Travel Documentation

Complete travel documentation (detailed itinerary, accommodation vouchers, pilgrim's credential, etc.) will be sent to the customer by email once full payment of the booking has been completed. It is the sole responsibility of the customer to ensure that they possess all necessary personal documentation (ID, passport, visas, European health card) in force for the trip. Ourway Travel S.L. will not assume any responsibility for problems arising from the lack or incorrectness of such documentation.

8. Accommodations and Services

The accommodations indicated in the itinerary are subject to availability at the time of booking confirmation. In case of unavailability, accommodation of equal or superior category will be offered. Some accommodations may be located at a reasonable distance from the official Camino route, with transportation to them being the customer's responsibility, unless otherwise indicated. Customers must communicate any special needs (reduced mobility, allergies, food intolerances) at the time of booking to manage services in the most appropriate way possible.

9. Prices and Exclusions

Prices indicated are per person and valid except for typographical errors. The package travel price includes only services expressly detailed in the itinerary and travel contract. As a general rule, services such as visas, hotel extras (minibar, laundry), tips, or any other service not specified are not included. Prices may be reviewed up to 20 days before departure due to variations in transport costs, taxes or exchange rates. An increase of more than 8% of the total price will allow the customer to terminate the contract.

10. Booking Transfer

The main contractor may transfer their booking to a third party who meets all the conditions required for the trip. Such transfer must be communicated in writing at least 7 calendar days before the start of the trip. Both the transferor and the transferee will be jointly liable for payment of the remaining price, as well as for the additional justified expenses that such transfer may occasion.

11. Contract Execution and Lack of Conformity

Customers are obliged to inform the agency as soon as possible of any lack of conformity observed during the execution of the trip. The agency must remedy such lack, unless it is impossible or involves disproportionate cost. If a significant part of the services cannot be provided as agreed, the agency will offer suitable alternative arrangements at no additional cost to the customer.

12. Unavoidable and Extraordinary Circumstances

In the event of unavoidable and extraordinary circumstances at the destination that significantly affect the execution of the trip, customers will have the right to terminate the contract before it starts without paying any penalty, being entitled to a full refund of any payment made, but not to additional compensation.
